The dispute between users and the operator of Porto Santo Marina appears far from over.
Users are now considering taking the concession's oversight, including compliance with the terms of reference, to the Public Prosecutor's Office. A previous publication in Funchal Notícias regarding a Spanish yachtsman's alert seems to have had some effect, as water and electricity will no longer be cut off for those with boats in the shipyard.
The terms of reference stipulate that the marina's operation must be a public service, with access to facilities and services only denied to those who violate legal provisions. Access to the marina's land areas must be free to the public, except as provided for in the marina's usage regulations.
Clause 38 of the Usage Regulations requires the operator to submit a proposed regulation within 90 days, subject to approval and public consultation. It remains to be seen if these deadlines were met, as otherwise, the regulations in force before the concession would prevail.
